Thursday, 16 April 2026<\/strong><\/p>\n<p style=\"text-align: justify;\" data-path-to-node=\"1\">India\u2019s legal landscape has undergone a seismic shift as of April 2026. While the core concepts of citizen empowerment remain, the &#8220;rules of engagement&#8221; for filing an FIR, seeking information via RTI, or moving a PIL have been modernized\u2014and in some cases, significantly restricted.<\/p>\n<h3 style=\"text-align: justify;\" data-path-to-node=\"3\"><b data-path-to-node=\"3\" data-index-in-node=\"0\">1. The FIR: Now under the Bharatiya Nagarik Suraksha Sanhita (BNSS)<\/b><\/h3>\n<p id=\"p-rc_0a37033a02ef76cf-28\" style=\"text-align: justify;\" data-path-to-node=\"4\"><span class=\"citation-56\">As of July 1, 2024, the colonial-era Code of Criminal Procedure (CrPC) was replaced by the <\/span><b data-path-to-node=\"4\" data-index-in-node=\"91\"><span class=\"citation-56\">BNSS<\/span><\/b><span class=\"citation-56 citation-end-56\">.<\/span> This changed how FIRs are handled:<\/p>\n<ul style=\"text-align: justify;\" data-path-to-node=\"5\">\n<li>\n<p id=\"p-rc_0a37033a02ef76cf-29\" data-path-to-node=\"5,0,0\"><b data-path-to-node=\"5,0,0\" data-index-in-node=\"0\"><span class=\"citation-55\">e-FIR Evolution:<\/span><\/b><span class=\"citation-55 citation-end-55\"> You can now register an FIR digitally from anywhere.<\/span> However, the law requires the informant to visit the police station within <b data-path-to-node=\"5,0,0\" data-index-in-node=\"145\">three days<\/b> to sign the physical document for it to be officially taken on record.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"5,1,0\"><b data-path-to-node=\"5,1,0\" data-index-in-node=\"0\">Preliminary Inquiry:<\/b> For certain offenses punishable by 3 to 7 years, the police can now conduct a &#8220;preliminary inquiry&#8221; within 14 days before registering a formal FIR, a move intended to prevent frivolous cases but criticized for potentially delaying justice.<\/p>\n<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.google.com\/search?q=https:\/\/matribhumisamachar.com\/en\/legal-reforms-2026&amp;authuser=1\">Latest Judicial Reforms in India 2026<\/a><\/p>\n<h3 style=\"text-align: justify;\" data-path-to-node=\"6\"><b data-path-to-node=\"6\" data-index-in-node=\"0\">2. PIL: The &#8220;Publicity Interest&#8221; Crackdown<\/b><\/h3>\n<p id=\"p-rc_0a37033a02ef76cf-30\" style=\"text-align: justify;\" data-path-to-node=\"7\"><span class=\"citation-54 citation-end-54\">In early 2026, the Supreme Court of India began taking a stricter stance on Public Interest Litigations.<\/span><\/p>\n<ul style=\"text-align: justify;\" data-path-to-node=\"8\">\n<li>\n<p id=\"p-rc_0a37033a02ef76cf-31\" data-path-to-node=\"8,0,0\"><b data-path-to-node=\"8,0,0\" data-index-in-node=\"0\">The &#8220;Publicity&#8221; Fine:<\/b><span class=\"citation-53 citation-end-53\"> In January 2026, the Court dismissed several petitions, labeling them &#8220;Publicity Interest Litigations.&#8221;<\/span> <span class=\"citation-52 citation-end-52\">The Bench emphasized that PILs should not be used as a platform for media attention.<\/span><\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"8,1,0\"><b data-path-to-node=\"8,1,0\" data-index-in-node=\"0\">Focus on marginalized groups:<\/b> The Court reiterated that PILs must primarily serve those who cannot access the courts themselves (the poor or disabled), rather than general policy debates that can be handled by the legislature.<\/p>\n<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\" data-path-to-node=\"9\"><b data-path-to-node=\"9\" data-index-in-node=\"0\">3. RTI: The &#8220;Body Blow&#8221; from DPDP Act 2023<\/b><\/h3>\n<p style=\"text-align: justify;\" data-path-to-node=\"10\">The Right to Information is currently facing its biggest challenge.<\/p>\n<ul style=\"text-align: justify;\" data-path-to-node=\"11\">\n<li>\n<p id=\"p-rc_0a37033a02ef76cf-32\" data-path-to-node=\"11,0,0\"><b data-path-to-node=\"11,0,0\" data-index-in-node=\"0\"><span class=\"citation-51\">Personal Information Ban:<\/span><\/b><span class=\"citation-51\"> Under the <\/span><b data-path-to-node=\"11,0,0\" data-index-in-node=\"36\"><span class=\"citation-51\">Digital Personal Data Protection (DPDP) Act<\/span><\/b><span class=\"citation-51 citation-end-51\">, Section 8(1)(j) of the RTI Act was amended.<\/span> <span class=\"citation-50 citation-end-50\">This effectively created a &#8220;blanket ban&#8221; on the disclosure of any personal information of government officials.<\/span><\/p>\n<\/li>\n<li>\n<p id=\"p-rc_0a37033a02ef76cf-33\" data-path-to-node=\"11,1,0\"><b data-path-to-node=\"11,1,0\" data-index-in-node=\"0\">Constitutional Challenge:<\/b><span class=\"citation-49\"> In February 2026, the Supreme Court referred petitions challenging this amendment to a <\/span><b data-path-to-node=\"11,1,0\" data-index-in-node=\"113\"><span class=\"citation-49\">Constitution Bench<\/span><\/b><span class=\"citation-49 citation-end-49\">.<\/span> <span class=\"citation-48 citation-end-48\">Critics argue that the government can now deny information regarding public spending or recruitment by labeling it &#8220;personal data.&#8221;<\/span><\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\" data-path-to-node=\"20,0\"><b data-path-to-node=\"20,0\" data-index-in-node=\"0\">Note:<\/b> While the original text suggests an FIR is always the &#8220;first step,&#8221; under the new <b data-path-to-node=\"20,0\" data-index-in-node=\"99\">BNSS (2024)<\/b>, a preliminary inquiry by police is now legally permitted in specific categories of crime before the FIR is even registered.
